Defination
- "Agreement" is a reference to these Terms and Conditions, the Privacy Policy, any order form and payment instructions provided to you;
- "Privacy Policy" means the policy displayed on our Website which details how we collect and store your personal data;
- "you", "your" and "yours" are references to you the person accessing this Website and ordering any Goods or Services from the Website or from any other channel provided by Priya’s
- "we", "us", "our", and "Priya’s" are references to the Company;
- "Goods" is a reference to any goods which we may offer for sale from our Website from time to time;
- "Service" or "Services" is a reference to any service which we may supply and which you may request via our Website;
- "Food Delivery" is a reference to perishable goods and to any form of delivery service, which both are provided by us and our Participating customer.
- "Website" is a reference to our Website www.eastindiancuisines.com or our mobile applications on which we offer our Goods or Services.
Delivery orders are subject to:
- Customer addresses falling in the delivery area (Mumbai and Thane). The delivery area is defined from time to time by Priya's at its discretion and is subject to change.
- Availability of Priya's products.
- In case the delivery locality and land mark not appropriate, delivery orders cannot be placed.
- Once the order has been placed it cannot be changed or cancelled by the customers for any reason.
- The price ofPriya's products is exclusive of delivery charges. The customer is liable to pay delivery charges (on the order placed through Priya's) as applicable from time to time.
- We shall use our best efforts to meet the scheduled delivery time conveyed on the phone to the customer, however, it does not guarantee these delivery timelines in every case. Priya’s shall not have any liability to customer if the customer's order fails to meet in whole or in part such scheduled delivery time.
- It is customer's responsibility to ensure that customer himself/herself or an appropriate person is available at the delivery address and he/she must pay in full for the order placed through. If customer or appropriate person fails to be present for Priya's delivery, we are entitled to charge the customer in full the amount of order and the cost of delivery.
- Upon delivery, customer shall pay in cash all charges (including delivery charges as applicable) incurred in connection with the order
Cancellation:
- You must notify us within 1hour of placing the order if you decide to cancel your order, preferably by phone, and quote your order number and order details. If we accepts your cancellation, no cancellation fee applies. If we refuses cancellation, e.g. because preparation of Food has been started, it may not be cancelled. We will not be able to cancel your order.
- We may cancel your order if the product is not available for any reason. We will notify you if this is the case.
You may not use the Site for any of the following purposes:
- Disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
- Transmitting material that encourages conduct that constitutes a criminal offence or results in civil liability or otherwise breaches any relevant laws, regulations or code of practice.
- Gaining unauthorized access to other computer systems.
- Interfering with any other person's use or enjoyment of the Site.
- Breaching any applicable laws;Interfering or disrupting networks or web sites connected to the Site.
- Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.
General:
- All prices are in Indian Rupees.
- We may alter or vary the Terms and Conditions at any time without notice to you.
- Payment must be made at the time of delivery by cash only. Delivery charges would be applicable for any other deliveries in Mumbai and Thane as applicable (Free delivery between Dahisar-west and Goregaon-west only for orders above INR 1000/-).
- Delivery time is within 24 hours and no order will be cancelled once placed.
- The Terms and Conditions together with the Privacy Policy, any order form and payment instructions constitute the entire agreement between you and us. No other terms whether expressed or implied shall form part of this Agreement. In the event of any conflict between these Terms and Conditions and any other term or provision on the Website, these Terms and Conditions shall prevail.
- If any term or condition of our Agreement shall be deemed invalid, illegal or unenforceable, the parties hereby agree that such term or condition shall be deemed to be deleted and the remainder of the Agreement shall continue in force without such term or condition.
- These Terms and Conditions and our Agreement shall be governed by and construed in accordance with the laws of India. The parties hereto submit to the exclusive jurisdiction of the courts of India.
- No delay or failure on our part to enforce our rights or remedies under the Agreement shall constitute a waiver on our part of such rights or remedies unless such waiver is confirmed in writing.
- These Terms and Conditions and a contract (and all non-contractual obligations arising out of or connected to them) shall be governed and construed in accordance with India Laws. Both we and you hereby submit to the non-exclusive jurisdiction of the India Courts. All dealings, correspondence and contacts between us shall be made or conducted in the English language.
